First Nations Elections and the Indian Act

The upcoming Driftpile Cree Nation election will be conducted in accordance with the election rules outlined in the Indian Act, as Driftpile Cree Nation does not operate under a custom electoral system.

Key Information:

  • Election Rules Under the Indian Act:

    • Section 78(1) of the Indian Act states: “Subject to this section, the chief and councilors of a band hold office for two years.”

    • The Indian Act does not provide any provisions for extending the mandate of the Chief and Council, even under extraordinary circumstances, such as a postal strike.

  • Decision-Making Process:

    • Elections, delays, or postponements are decided in consultation with electoral officers by the Chief and Council in collaboration with Band Management.

    • In cases where a decision to postpone beyond the mandate is deemed necessary, it is crucial for Nations to implement measures that prevent governance gaps and ensure the Nation’s administration can function independently on an interim basis.
